Paak Communication is a digital agency operating from 208 Business Arcade, Karachi, Sindh 75300, Pakistan. Throughout these Terms, 'we', 'us' and 'our' refer to Paak Communication; 'you' and 'your' refer to the individual or organisation accessing the website or engaging our services.
You may use this website for lawful purposes only. You agree not to: copy, reproduce or republish material from the site without permission; attempt to gain unauthorised access to our systems; use any automated means to scrape the site; transmit malware, spam or other harmful content; or use the site in a way that damages our reputation or interferes with other users.
All content on this website — text, graphics, logos, images, code, downloadable documents — is owned by Paak Communication or used with permission, and is protected by intellectual-property law. You may not reproduce, redistribute or create derivative works from this content without our prior written consent.
Any paid engagement is governed by a separate, signed Master Services Agreement (MSA) and Statement of Work (SOW). Where these Terms and the signed MSA/SOW conflict, the signed agreement prevails. Project pricing, deliverables, timelines, change-control procedures and payment terms are set out in the SOW.
Unless otherwise agreed in writing, monthly retainers are invoiced in advance and project milestones are invoiced as completed. Invoices are due within 14 days of issue. Late payments accrue interest at 1.5% per month or the maximum allowed by applicable law, whichever is lower. We reserve the right to suspend work on accounts more than 30 days overdue.
Timely delivery depends on your inputs. You agree to provide required content, approvals, credentials and feedback within the timeframes agreed in the SOW. Delays caused by missing client inputs may shift the project timeline and are not grounds for refund.
Both parties agree to keep confidential information shared during an engagement private and to use it only for the purpose of performing the engagement. Confidentiality obligations survive termination of the engagement for three (3) years.
We warrant that services will be performed with reasonable skill and care. Except as expressly stated, all services are provided 'as is' without further warranty. To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with any engagement shall not exceed the fees paid by you in the three (3) months preceding the event giving rise to the claim. Neither party is liable for indirect, incidental or consequential damages.
Our services may involve third-party platforms (Google Ads, Microsoft Advertising, Meta, AWS, Cloudflare, Shopify, etc.). Use of such platforms is governed by their own terms and is your responsibility. We are not liable for changes in third-party platform policies, pricing or availability.
Monthly retainers may be terminated by either party with 30 days written notice. Project engagements may be terminated as set out in the SOW. On termination we will hand over all deliverables completed and paid for, and refund any unused pre-paid retainer hours on a pro-rata basis. See our Refund Policy.
These Terms are governed by the laws of the Islamic Republic of Pakistan. Any dispute that cannot be resolved through good-faith discussion shall be submitted to the exclusive jurisdiction of the courts of Karachi, unless an alternative jurisdiction is set out in a signed MSA.
We may update these Terms from time to time. The latest version will always be posted on this page with an updated 'Last updated' date. Continued use of the website after changes are posted constitutes acceptance.
